Appeal Court Dismisses Abure’s Appeal, Affirms Nasarawa High Court Ruling, Awards N10m Cost

The Court of Appeal has dismissed the appeal filed by Julius Abure, the embattled former National Chairman of the Labour Party (LP), challenging the interim orders granted by a Nasarawa State High Court in favour of a faction led by Senator Nenadi Usman.

In a judgment delivered on Tuesday, the appellate court berated the Nasarawa High Court judge who granted the interim order, describing the action as reckless and lacking jurisdiction. The court held that the constitution of an interim committee is an internal affair of the party and that the suit in the lower court was against the Independent National Electoral Commission (INEC), not an internal party matter.

The Court of Appeal affirmed the decision of the lower court, declaring that the appeal was devoid of merit. It further awarded a cost of N10 million against Abure.

The ruling is a significant blow to Abure’s faction in the protracted leadership crisis that has plagued the Labour Party. The party’s national leadership has been a subject of intense legal battles, with the Nasarawa High Court previously granting orders that favoured a faction led by Nenadi Usman, prompting Abure’s appeal.

The Court of Appeal’s decision effectively upholds the position that INEC is the proper respondent in such matters and that the internal composition of party committees is not subject to judicial interference.

As of press time, Abure and his legal team have yet to issue an official statement on the ruling.
