The Independent National Electoral Commission (INEC) has approached the Court of Appeal in Abuja to stay the execution of a Federal High Court judgment that ordered the deregistration of the African Democratic Congress (ADC) and four other political parties .
The affected parties are the Action Peoples Party (APP), Action Alliance (AA), Accord Party, and Zenith Labour Party (ZLP) .
At Tuesday’s proceedings before a three-member panel, INEC, through its legal team led by Haliru Mohammed, expressed shock that Justice Peter Lifu delivered the judgment despite a May 22 order from the appellate court that stopped him from doing so . The electoral body said it was not notified of the delivery and only learned of the ruling through media reports .
The INEC moves to halt enforcement of judgment deregistering ADC as it also backed the notice of appeal filed by the affected parties . Counsel to ADC, Shuaibu Aruwa (SAN), urged the appellate court to invoke disciplinary powers, arguing that the trial judge dared the court by disregarding its order .
The parties also warned that enforcing the ruling could disrupt by-elections scheduled for June 20 in six states .
