Counsel to the Osun State Government, Prof. Mubarak Adekilekun (SAN), has said no court order was served on the state government or First Bank before the restriction of access to the state’s statutory allocation account.
CDA News Nigeria reports that Adekilekun made the disclosure on Friday while speaking on Channels Television’s Politics Today amid the controversy surrounding the Economic and Financial Crimes Commission (EFCC) directive.
According to the state counsel, the law requires a court order to be issued and properly served, particularly on the affected bank, before such a restriction can be enforced.
Adekilekun said the EFCC’s letter directing the restriction was later transmitted to the Osun State Government. However, he stated that First Bank confirmed that no court order was attached to the letter.
The development has added to the growing controversy over the Osun account freeze, with the state government questioning the legal basis for restricting access to its statutory allocation account.
The EFCC has maintained that its actions were based on its investigation and legal powers. The agency has also explained its position on the restriction amid growing public debate.
The dispute has sparked wider discussions about the powers of anti-graft agencies and the legal procedures required when government accounts are restricted.
