The Supreme Court has restored the final forfeiture of properties linked to former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, overturning an earlier judgment of the Court of Appeal that had nullified the forfeiture order and directed a fresh hearing.
CDA News Nigeria gathered that a five-member panel of the apex court unanimously allowed the appeal filed by the Economic and Financial Crimes Commission (EFCC) and set aside the decision of the Court of Appeal, Lagos Division. The Supreme Court consequently reinstated the judgment of the Federal High Court in Lagos, which had ordered the final forfeiture of the assets to the Federal Government.
The Federal High Court had ruled that the seven high-value properties and about $2.045 million in cash were reasonably suspected to be proceeds of unlawful activities. While the Court of Appeal later ordered a retrial, the EFCC challenged that decision before the Supreme Court.
CDA News Nigeria reports that the Supreme Court’s decision effectively brings the appeal over the forfeiture order to a close, reaffirming the Federal High Court’s ruling in favour of the EFCC.
