Court Orders Atiku to Serve Tinubu with 2027 Eligibility Suit Through APC

…Seven-Day Deadline Set as NYSC Certificate Forgery Case Advances

The Federal High Court in Abuja has granted an application by former Vice President Atiku Abubakar to serve President Bola Tinubu with court documents through the All Progressives Congress (APC) in a suit seeking to disqualify the President from the 2027 presidential election.

CDA News Nigeria reports that Justice Inyang Ekwo granted the ex parte motion moved by Atiku’s counsel, O.T. Omotayo-Ojo, on Wednesday, September 16, 2026. The court ordered that service be effected within seven days and adjourned the matter until September 28 for mention.

CDA News Nigeria gathered that the application became necessary after efforts to personally serve President Tinubu with the originating summons were unsuccessful. Atiku’s lawyer, Silas Onu, had informed the court on September 1 that his client was yet to effect personal service on the President. 

The suit, marked FHC/ABJ/CS/1888/2026, was filed by Atiku and his party, the African Democratic Congress (ADC). Listed as defendants are President Tinubu (1st), the APC (2nd), and the Independent National Electoral Commission (3rd) .

Atiku alleges that the APC submitted a forged National Youth Service Corps (NYSC) discharge certificate bearing the name “Tinubu Bola Adekunle” to INEC, which he claims differs from the President’s name, Bola Ahmed Tinubu. The plaintiffs are seeking an order compelling INEC to remove Tinubu and the APC from the list of candidates for the 2027 presidential poll 

President Tinubu and the APC have filed a joint counter-affidavit denying the allegations. They stated that no forged certificate was submitted to INEC for either the 2023 or 2027 elections, adding that the NYSC has never denied issuing a discharge certificate to Tinubu.
