PORT HARCOURT – The political fate of Rivers State Governor Siminalayi Fubara is now in the hands of a four-justice panel of the Court of Appeal, which is scheduled to hear a critical case between February 2 and 10, 2026, potentially deciding the future of the impeachment proceedings against him.
The panel, presided over by Hon. Justice Oluwayemisi E. Williams-Dawodu, includes Justices Muhammad Ibrahim Sirajo, Hannatu Azumi Laja-Balogun, and Ishaq Mohammed Sani. They will determine the validity of a High Court injunction that has currently stalled the impeachment process initiated by the state House of Assembly.
The justices represent a mix of legal expertise, from procedural scrutiny to constitutional analysis. Their ruling will answer the central question of whether the courts can intervene in a legislative impeachment process as outlined in Section 188 of the Constitution. A senior Port Harcourt lawyer outlined three possible outcomes to the court: a “literalist knockout” allowing impeachment to proceed, a “procedural shield” nullifying the Assembly’s actions, or a “stay of execution” that maintains the current uneasy status quo.
The Assembly faction loyal to FCT Minister Nyesom Wike has filed for an urgent hearing, arguing that state governance is in jeopardy. As legal briefs are exchanged and security is expected to tighten around the Moscow Road court, the entire state awaits a judicial verdict that will have immediate and profound political consequences.
