The Independent National Electoral Commission has officially stated it cannot recognize the Kabiru Turaki-led National Working Committee of the Peoples Democratic Party, citing subsisting court judgments that restrain it from doing so.
In a letter dated December 22, 2025, and signed by its Secretary, Rose Oriaran-Anthony, INEC responded to requests from PDP legal representatives seeking recognition for officials elected at the party’s National Convention held in Ibadan on November 15-16.
The commission clarified that its decision is based on a review of material facts, extant laws, and, crucially, two final judgments from the Federal High Court in Abuja (Suit Nos. FHC/ABJ/CS/2120/2025 and FHC/ABJ/CS/2299/2025).
“Both judgments, which are final in nature and binding on all parties, expressly restrained the commission from supervising, monitoring, recognising, or in any manner whatsoever giving effect to the outcome of the PDP national convention,” INEC stated.
The electoral body noted that while notices of appeal have been filed, the filing of an appeal does not constitute a stay of execution. Therefore, until the judgments are set aside or stayed by a competent court, INEC remains bound by law to obey them.
The commission also referenced an interim order from the Oyo State High Court but clarified that it had been struck out from that suit for lack of jurisdiction, adding that interim orders cannot override final judgments.
INEC revealed that another suit filed by the PDP is pending before the Federal High Court in Ibadan, seeking to compel the commission’s recognition. It assured stakeholders of its commitment to acting strictly within constitutional bounds and the rule of law.
