The Federal High Court in Abuja has ordered the Corporate Affairs Commission (CAC) to immediately reinstate Ambassador Sukubo Sara-Igbe Sukubo and other members of the Board of Trustees (BoT) of the National Youth Council of Nigeria (NYCN).
Delivering judgment on Friday, Justice Binta Nyako ruled that the CAC acted beyond its statutory powers when it deregistered the NYCN and established an Interim Management Committee to oversee the affairs of the youth body.
According to the court, the commission does not have the legal authority to determine the tenure of leaders of an association or appoint an interim leadership structure for a registered organisation.
Justice Nyako subsequently nullified the deregistration of the NYCN and directed the CAC to restore the council’s status, recognise Ambassador Sukubo and other duly registered trustees as the legitimate leadership of the BoT, and immediately dissolve the Interim Management Committee.
The judgment effectively returns the NYCN to its previous leadership structure pending any further legal proceedings.
